Z&G Collection

This contract has been prepared based on the obligation to make a contract for sales made over the internet in accordance with the Regulation on the Application Procedures and Principles of Distance Contracts published in the Official Gazette dated 27.11.2014 and numbered 29188, and the articles are as follows.

ARTICLE 1 - SUBJECT

The subject of this contract covers the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers - Regulation on the Application Principles and Procedures of Distance Contracts, regarding the sale and delivery of the product, the characteristics and sales price of which are specified below, which the seller sells to the consumer.

ARTICLE 4 - PRODUCT INFORMATION SUBJECT TO THE CONTRACT

The type, quantity, brand/model, color, number, sales price, payment type of the Goods/Product/Service consist of the information at the time the order is confirmed.

 

ARTICLE 5 - GENERAL PROVISIONS

5.1- The consumer declares that he/she has read and is informed about the basic characteristics, sales price, payment method and all preliminary information regarding delivery of the product or products that are the subject of the contract specified in Article 4 and has given the necessary confirmation electronically.

 5.2 - The product or products subject to the contract shall be delivered to the consumer or the person or organization at the address indicated by the consumer within the period specified in the preliminary information, depending on the distance of the consumer's place of residence, provided that the legal period of 30 days is not exceeded. This period may be extended by a maximum of 10 days, provided that the consumer is notified in advance.

5.3 - If the product in question is to be delivered to a person or organization other than the consumer, Z&G Collection cannot be held responsible if the person or organization does not accept the delivery.

 5.4 - Z&G Collection is responsible for the delivery of the contractual product, which is intact, complete, in accordance with the specifications specified in the order and with warranty documents and user manuals, if any.

5.5 - For the delivery of the contractual product, it is required that the signed copy of this contract be delivered to Z&G Collection and the price be paid using the payment method preferred by the consumer. If the product price is not paid for any reason or is cancelled in the bank records; Z&G Collection is deemed to be relieved of its obligation to deliver the product.

5.6 - If the relevant bank or financial institution does not pay the price of the product to Z&G Collection due to the unfair or illegal use of the consumer's credit card by unauthorized persons for reasons not caused by the consumer's fault after the delivery of the product, the product must be sent to Z&G Collection within 3 days, provided that it has been delivered to the consumer. In this case, the shipping costs are the responsibility of the consumer.

 5.7 - If Z&G Collection cannot deliver the contracted product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions or transportation disruptions, it is obliged to notify the consumer. In this case, the consumer may exercise one of the following rights: cancellation of the order, replacement of the contracted product with a similar one, if any, and/or postponement of the delivery period until the preventing situation is eliminated. If the consumer cancels the order, the amount paid by the consumer shall be paid to the consumer in cash and in a single transaction within 15 working days.

5.8 - Products that are defective or broken, whether sold with or without a warranty certificate, can be sent to Z&G Collection for the necessary repairs under warranty conditions, in which case the shipping costs will be covered by Z&G Collection.

5.9 - This contract becomes valid after it is signed by the consumer and delivered to Z&G Collection by fax or mail, or after the consumer approves the contract on the website.

 5.10 - Prices of products on the Z&G Collection website include VAT and exclude shipping costs. Promotional campaigns are also carried out with all rights reserved.

ARTICLE 6 - RIGHT OF WITHDRAWAL

The consumer has the right of withdrawal within (14) days from the delivery of the contractual product to him/her or to the person or organization at the address he/she has indicated. In order to exercise the right of withdrawal, Z&G Collection must be notified by fax, e-mail or telephone within this period and the product must not have been used within the framework of the provisions of the relevant article. In the event of exercising this right, a copy of the shipping delivery report stating that the product delivered to a 3rd party or consumer was sent to Z&G Collection and the original invoice must be returned. The product price will be refunded to the consumer within 15 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded. The shipping costs of the product returned due to the right of withdrawal are covered by the sender.

The right of withdrawal cannot be exercised for products that cannot be returned due to their nature, single-use products, copyable software and programs, products that deteriorate quickly or have expired. In order to exercise the right of withdrawal, the packaging of the product must be unopened, undamaged and the product must be unused.

In case of exercising the right of withdrawal, Z&G Collection is obliged to cover the return shipping costs for returns that are in accordance with the law.

The consumer cannot exercise his/her right of withdrawal for goods that are produced in line with the consumer's special wishes and demands or that have been personalized by making changes or additions.

If the payment is made by credit card or a similar payment card, the consumer may request that the payment transaction be cancelled on the grounds that the card was used without his/her consent and in an unlawful manner. In this case, the institution that issued the card shall refund the payment amount to the consumer within 15 business days from the notification of the objection.

In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts at the place of residence of Z&G Collection are authorized up to the value declared by the Ministry of Industry and Trade.

If the consumer meets all the conditions and wishes to exercise his/her right of withdrawal, he/she may inform us that he/she wishes to exercise his/her right of withdrawal by filling in the form here.

If the consumer's problem is not resolved by Z&G Collection, the consumer may apply to Consumer Rights in order to seek his/her rights. The consumer can obtain detailed information about consumer rights from tuketici.gov.tr.

ARTICLE 7 - SHIPPING AND DELIVERY

Shipping:

Once your order confirmation email is sent, the products are delivered to our contracted Sürat Kargo or Yurtiçi Kargo Company.

Delivery:

The products will be delivered to the address you specified by our contracted company Sürat Kargo or Yurtiçi Kargo. The delivery time from our company to the shipping company is 7 (seven) business days at the latest after the order confirmation e-mail is sent. Products are sent to regions where shipping companies do not deliver to addresses with a phone call.

In regions where the Shipping Company delivers once a week, there may be a delay in the specified day period in cases of inaccuracies or deficiencies in the shipping information, some social events and natural disasters. If the product is to be delivered to a person/organization other than the consumer, the seller cannot be held responsible for any extra shipping costs that may arise from the person/organization not accepting the delivery, the incorrect shipping information and/or the consumer not being at the location.

In case of damaged package;

Damaged packages should not be accepted and a report should be prepared by the transportation company representative. If the transportation company representative is of the opinion that the package is not damaged, the consumer has the right to have the package opened there, to check that the products were delivered without damage and to have the situation recorded in a report. Once the package is received by the consumer, it is accepted that the transportation company has fulfilled its duty. If the package is not accepted and a report is prepared, the situation should be reported to our customer service as soon as possible, together with the copy of the report that the consumer has. Our customer service will take immediate action to resolve the problem.

ARTICLE 8 - PRIVACY POLICY

No:14 K:3 Güngören/İstanbul, will not use the personal information provided by users via www.zg-collection.com ("website") for purposes other than those specified in the Privacy Policy and will not share it with third parties without permission. The user allows the use of the information they have shared for the purposes of offering special advantages to them and for the notification of all kinds of communication activities for sales, marketing and similar purposes.

Personal information includes any personal information that directly or indirectly identifies the user, such as name and surname, date of birth, home address, mobile and landline telephone number, e-mail address, and will be referred to as "Confidential Information".

Z&G Collection may use personal information for its own profiling, statistical studies, advertising, promotion, marketing and other communication activities.

Z&G Collection undertakes to keep personal information strictly confidential, to consider this as a confidentiality obligation, to take the necessary measures and show due diligence to ensure and maintain confidentiality, to prevent all or any part of confidential information from entering the public domain, unauthorized use or disclosure to a third party. Despite Z&G Collection taking the necessary information security measures, Z&G Collection will not have any liability in the event that confidential information is damaged or falls into the hands of third parties as a result of attacks on the website and the system.

Z&G Collection can obtain information about users and their use of the Website using a technical communication file (Cookie). However, users can change their browser settings so that the technical communication file is not received or a warning is given when the technical communication file is sent.

Article 9 - AUTHORIZED COURTS AND ENFORCEMENT OFFICES IN CASE OF DISPUTE

In case of dispute arising from the implementation of this contract, the courts in Istanbul Province have jurisdiction.

If the order is placed, the consumer is deemed to have accepted all the terms of this agreement.
